Illegalizing of commercial sex
Commercial sex in the society has always been regarded as the oldest profession with justification for the aspect behind it. Although the act of prostitution may have been in existence in the society throughout history, the toleration has always not been considered from either moral or legal perspective. Prostitution/commercial sex results to the spread of the majority of sexually transmitted diseases inclusive of HIV/Aids (Flowers, 2008). The act of prostitution should not be legalized with specifications to the following reasons:
It violates the physical and moral integrity rights through the alienation of the society’s women sexuality appropriated, reduced and debased to the relative commodity meant for buying and selling. The act of prostitution violets torture prohibition and inhuman, cruel or a degrading treatment since the clients’ practices and acts of the respective sexual entertainment involves power and violence over the body of the female (Flowers, 2008).
Prostitution in the society violates the significant right to security and liberty with the prohibition of slavery, human trafficking and forced labor in persons since the majority of women and girls are in various sexual slavery. This is with the intent of meeting the demand of the male buyers of sex with the generation of profits to the capitalists of sex. The practicing of prostitution violates the society’s individual to enjoy mental and physical health in higher standards since; disease, violence, unsafe abortions, unwanted pregnancies and AIDS stalk presentation of constant risks for the respective women involved in the act (Flowers, 2008). It also violates the aspect of militating against healthy sense of relationships with their respective bodies.
The society believes that prostitution is a violation of the human sexuality autonomy. The society consider the fact that sexual relations have significance, private and so personal, therefore, should be under no circumstances should be sold on the aspect of raising money to survive. The legalization of the vice in the society might results into the creation of pressures that are not welcomed on the society’s sexual attitudes (Flowers, 2008). The society believes that the cases involving the legalization of prostitution would lead to the development of brand loyalty, the establishment of tie-ins to related consumer goods with a corresponding creation of a niche markets in regards to under-served needs.
Following some of the dreadful moral elements that associate with the legalization of prostitution, the society believes that illegalizing the act is the best option. This is due to the fact that prostitution encourages clandestine, enables the increment of the sex industry and child prostitution. It also does not at any point promote the health of women, and does not enhance the choice of women. The society in regard to the resulting negative impacts of the vice, they have a strong feeling of illegalizing it with the setting up of procedural policies to help establish it is control (Flowers, 2008).
The vice has proven to be a problem without satisfying solution. Commercial sex in the society can be a relatively sordid enterprise and hard to integrate. The separation of sexual activity from the relative relationships of responsibility and caring as an enterprise is hazardous to the moral health. The society believes that it matters on how to make evolutions of the right procedure with total orientation to the aspect of morality, weight and legality in relation to the responsibility in promoting decency in the society. The society brings up as justifiable aspect in considering illegalizing the acts inclusive of regulation introduction (Flowers, 2008). The aspect of regulation involves monitoring the health of the respective prostitutes and imposing standards for conducts.
The society perceives the significant factor behind sex which requires everyone to handle it with dignity and difference hence necessitating more protection. There is the belief that only through considering going to the major cause of the act of prostitution will enable the elimination of roots with abuse of children and women. The society should consider urging the respective government’s religious communities and NGO’s to consider focusing on the reduction of the victim’s demand of prostitution. All the respective formulated components of demand should be put under procedural framework with penalization of the offenders (Flowers, 2008). This involves the pimps profiting from sales and traffickers of children and women for sex, the states responsible for funding the deceptive acts that promote prostitution and the respective culture lying concerning the prostitution nature.
The reduction of the number of the victims in the society is possible following the emphasis made on the elements behind actions. This necessitates motivation and society universal principles treating everyone in the society with respect and morals. When making the decision to illegalize prostitution, it is crucial for the society to of understanding that despite the related problems in the perspective of ethical, political, religious, cultural and the economic affiliations. This also involves conforming to the set principles with extensive aspect if liberty systems. The society’s existing norms that may hinder the mitigation of the prostitution related issues involves code and should learn to learn from the existing differences (Flowers, 2008).
Theory of human freedom
Through his theory of human freedom, Spinoza argues that, for any human action or state of mind, there should be a causal explanation as to the reason why this action came to be or why a person has a state of mind. The explanation as to the reason of this is a person’s environment. Spinoza argues that any meaningful freedom that human beings posses is contentious. He goes ahead to state that there is a freedom achieved through knowledge of God and the universe. According to him, something is free about in accordance to nature (Kisner, 2011). The actions of someone explain if a person is free. According to Spinoza, the value of something depends on its knowledge of nature and the surrounding. Real freedom means the act of acting according to the nature of human beings. Following the determined conatus, determines whether a person is free. Self-preservation alone is exceedingly distinctive when Spinoza talks about freedom.
Human beings have the power of self-assertion and a drive to preserve them. Both this two things have a mental and physical aspect. The mental aspect is the capacity to think in an active manner. This also determines whether a person makes decisions that are clear and concise. This is what constitutes the essence of individualism in human beings. According to Spinoza, the actions of human beings are effects of the appetites of their individualism (Kisner, 2011). The actions of human beings are also effects of external things that affect human beings. These effects are not conscious or unconscious. The effects of their desires, however, are conscious.
The fundamental appetite of human beings is preserving themselves. Human beings also preserve their power and liberty in relation to the external things that affect them directly. Human beings can express their power of thought at different levels of the activities that they do. The nature of the external environment also determines the level of expression. Spinoza states that human beings attain freedom by how they govern themselves according to principles that they hold. This, to him, expresses humans’ moral commitments. Spinoza holds that freedom is the existence of options to situations and the ability of a person to make judgments and decisions that are valuable and just (Kisner, 2011). Humans have the authority to act as they please but must be ready to acknowledge the costs of those actions.
Spinoza holds that is a positive intellectual capacity for human beings to act for the sole reason of attaining their ends. Human beings should be aware that all actions limited by the natural law. Freedom means that a person’s own nature controls him or her. A person’s nature may be different from another person’s nature. This is the reason why people act differently in the world. Spinoza explains that people are free if the causes of their actions are internal. A person is not free if the cause of their action is external. The greatest enemy to a man’s freedom is his own emotions (Kisner, 2011). A person’s passion is what may hinder him or her to be free. A person should free himself from the bonds of passion or at least try to control them. A person seeking freedom first should free himself relying on senses and imagination. When he does this, then he or she should learn to rely on his or her own rationality. For a person to get liberation and become free, he must acquire knowledge. This makes the individual not prone to external circumstances.
Human freedom theory and the illegalization of commercial sex
The decision to illegalize commercial sex should come from the majority of people. In the case of a referendum whereby people have to vote for illegalizing of commercial sex, a person should make his decision alone. One should not let external factors determine how he or she is going to vote. A person should free to make decisions as per his or her nature. The human freedom theory suggests that people should not let their emotions and desires influence how they make decisions. People should learn how to control their desires. This will make people make right decisions. It is a well-known fact that commercial sex is a social vice in the community. For a person to make a decision to legalize it would be a total dismay since deep down, the person knows that commercial sex is not good.
Commercial sex in the society leads to infidelity cases and spread of sexually transmitted diseases. People should take into consideration the factors pertaining to the issue before making a decision. Everyone in the society has his own principles. These principles enable a person to know what is right and what is wrong according to them. These principles also enable a person to think broadly and understand what is good and what is immoral. This will help a person make rational decisions. A person should be rational in the decisions that he makes. People should take the decision to illegalize commercial sex serious and should vote according to their internal nature.
