LEARNING ACTIVITY 1:

This learning activity focuses on jurisdiction and alternative dispute resolution (“ADR”)

Case Scenario: Ross owns and operates a florist business named Blossom World, Inc. (“Blossom”), from a shop in his Ohio hometown. Blossom advertises and sells in Ohio from the shop, and also advertises and sells over the internet. Using Blossom’s website, on May 5th, Louise purchased $50,000 worth of live wedding flowers using her credit card, from her home in Dallas, Texas. She requested the flowers to be shipped and delivered by May 15th to a hotel in Indiana, the site of the wedding. The flowers arrived on May 14th, the day before the wedding, but Louise claimed they were withered and unusable.

Louise sued Flowers in a Texas state court to recover her $50,000. Ross, on behalf of Blossom, filed a motion to dismiss, claiming that the Texas court lacks jurisdiction.

A. Which court(s) have jurisdiction to hear this case, and why?

B. What is the legal basis for the court’s jurisdiction over Flowers (i.e., what type of jurisdiction exists over Blossom World)?

C. If Louis had not yet filed suit, and Ross contacted you for advice, would you advise Ross to use ADR (if so, which type) or to go to court to resolve this dispute? State your rationale for your position.

Learning Activity 2:

This learning activity focuses on constitutional authority to regulate business and constitutional law concepts.

Case Scenario: City enacted a city zoning ordinance that barred outdoor advertising display signs – including billboards – on all public roads within the city limits. Billboards on-site on any public or private business location are exempt from this ordinance, and thus, permissible. City claimed that the ordinance was necessary to promote public traffic safety and aesthetics.

Max, Inc., a company in the business of leasing commercial billboards to advertisers, and the primary billboard provider in City, sued City alleging the zoning ordinance is unconstitutional.

A. You are an attorney representing either City or Max, Inc. State which side you represent, then explain you argument for why the jury should rule in your client’s favor regarding the constitutionality of the ordinance?

B. How would you advise City to revise the ordinance in a way likely to avoid potential constitutional violations?
