A state, the victim of aggression, is not bound by jus in bello rules if:

There is public proof that the aggressor is about the defeat the victim militarily; and,

There is public proof that the aggressor will institute brutally massacre and enslave the members of the victim state

In such cases, the victim state is morally permitted to what is must to fight back the aggressor (but only as long as the supreme emergency exists)
