Occupational Safety and Health Administration (OSHA) sanctions

  1. Opening thought-

“Safety management traditionally means safety programs, committees, rules and inspections.  Companies that have average safety systems can find their results are average, or worse. Companies that want to excel in safety go further by integrating safety into daily activities, with lots of management and employee responsibility and mutual participation.”

In what ways could you, as a safety professional, promote safety and protect your organization from Occupational Safety and Health Administration (OSHA) sanctions?

2. Opening thought-

“Pushed by a federal appeals court decision, the Occupational Safety and Health Administration (OSHA) wants to make changes in its respirator and training standards which will allow it to assess a penalty on a company on a per-employee violation basis. The U.S. Court of Appeals for the Fifth Circuit ruled in 2005 that OSHA went beyond the language of the two standards in fining a construction company for 11 violations of the asbestos standard based on the fact that the company did not provide 11 employees with respirators or training for removing asbestos. The court affirmed an earlier decision by the agency’s Occupational Safety and Health Review Commission which said OSHA had to assess an “aggregate” penalty against the Houston company called Ho Ho Ho Express, Inc.”

How much authority should the Occupational Safety and Health Administration (OSHA) have for investigating incidents that take place in private organizations? Does OSHA has too much authority or too little? Explain your response.
